The Whole 'Let The People Vote' On Gay Marriage Is Just A Farce

I remember getting into a heated argument with somebody at Gaypatriot.net over letting gay marriage be voted on by the people. The "gay" conservative (that also called me a "pot head" and a "terrorist" for not being a conservative like him) was supporting the notion that people had to be allowed to vote on gay marriage because it was their right and that "voting was a constitutional right." Actually, no. That is not true. Our Constitution sets up a form of government that is ruled by law not by majority will. People vote for the congress and the congress are the people per the Constitution. Whenever the Congress or a State takes someone to court for a crime or civil matter it is always "The People Vs X" because "the people" is represented by someone else. Never would the actual populace be in charge of suing on behalf of the state, the Attorney General does that according to law.

And today many people who think like this "gay" conservative (who hates himself for being gay and is opposed to anything gay people do and express) are forgetting that our form of government is not a continuous rebellion where the people are directly ratifying every little action our government does. They are forgetting that we live in a constitutional republic where minority rights are protected which is why our founding fathers opted for many of the amendments in the bill of rights. These rights protect the unpopular (like gays today), meaning that rights like freedom of speech are to be protected not because speech is popular, popular speech needs no protections (like straights today), it is unpopular speech that needs protection. Same is true for religion and due process rights.

But what this "gay" conservative was trying to convey is that people should have the right to vote on whether or not these constitutional rights are appropriate for certain people when its popular (like banning gay marriage). This was never the intention of the framers of our constitution. Our constitutional rights are always protected for all people at all times regardless if its popular or not. This guarantees a rather constant free republic, not  chaotic swings of moods or fads. In fact if the proposed Declaration of Independence was placed on the ballot in 1776 it would have failed, since it was a minority of people that supported and fought against the British. We had a continental congress back then, and its job was to decide on the people's behalf what is right since these men in that congress are thought to be well educated, experienced, and learned enough to make decisions that the ordinary voter is too busy or uneducated about. And at that time these men made a decision that forever changed the landscape of the continent and human history.

A public will vote what is "popular" that moment, rather then approving something because it has merit. For laws need to make sense and be permanent, otherwise why even bother to write the laws in the beginning if you are going to change your mind on them next week. We cannot afford chaos, what we need is constant liberty. And I do believe in the line that the "government that governs least, governs best." When states want to outlaw marriage, what they are doing is not "protecting" marriage, but just add more laws on top of laws that are completely unnecessary since the proponents' intentions are in fact, after reading their own arguments, that government's role is to "mold" people. That is a very dangerous proposition that we must reject. Our government is not there to "mold" us, it is there to protect our rights and our liberties, at the individual, familial, and professional level.

And when people start moping around that the government doesn't let them vote on gay marriage, I am forced to question their logic and of course brain function. What is at stake here, in their own mind, is NOT democracy, but rather stopping something that is "unpopular" simply for the sake of stopping it due to supposed religious beliefs and prejudices. The democracy part is simply a means to an end. And frankly, those who oppose gay marriage would give a rats ass about democracy or "letting the people vote," - lets be honest, its all about stopping gay marriage. This has got to be one of the most ambitious yet elementary scams in US political history. The people that promote this idea that we must vote on gay marriage to preserve democracy are simply insulting my intelligence. If these people were at all serious with this "let the people vote" meme then why not apply it to even more serious issues that actually affect everyone directly. Why not "let the people vote" on whether or not to go to war (oh that's a big one) or to give more bailout money to the rich bankers (oh that would be nice) or to let the voters decide if they want to fire congress right on the spot (gee I would love that idea) - but no. Not a peep from the so-called "democracy loving" card-carrying conservative robots. All this "let the people vote" mambo-jambo is all a sick joke. Because if they were serious about it, then they should let us, the people, all vote on anything we want.

But we all know that is never going to happen, and these anti-gay shills need to wake up and realize that they are nothing but chumps for those who convinced them of this farce.
