I was very enthusiastic about the recent Prop 8 ruling declaring the anti-gay marriage ban as unconstitutional reaching a more narrow ruling that Prop 8 was in violation of the findings in the Romer vs Evans case, which involved the Colorado electorate taking away anti-discrimination rights from gay people and where the Court found that taking away rights on the basis of sexual orientation was unconstitutional.In planning to write a response and a prediction of how the Prop 8 case will end I decided to take all aspects of the current court into account. In the beginning I was planning to predict that the Supreme Court will indeed uphold ninth circuit court ruling on Prop 8. That was until I realized that this court is no longer our court, but a vehicle upon which The Vatican can exercise its might on the United States. I just remembered that it was not until recently that the court has been loaded with Catholics, and after Sotomayor's ascension to the court, the Vatican has 6 out of the 9 jurists at its disposal.
To say that these justices will not adhere to Vatican rule but would apply the law justly is being completely naive. The Vatican has strict oversight on Catholic public figures, including lawmakers and judges. The difference between a Protestant and a Catholic judge is that if the Catholic judge rules against the Vatican he will face consequences including excommunication. Such devices have been employed in the past on Catholic politicians who don't toe the Vatican line of thinking. But a Protestant judge who rules against his teachings will still face scrutiny by his church and congregation, and may even be booted out of his church. However, the difference here is that Protestant churches have no worldwide oversight by one single all-seeing authority as many of these mainline denominations are autonomous. With that in mind the judge will simply join another church or congregation down the street who will not have a problem with his ruling. In Catholic orthodoxy there is no such liberty, since individual liberty and freedom are in fact blasphemy to this occult foreign Church.
The Catholic church wheels tremendous power in the religious right and is in fact the financial machine behind all of today's anti-gay movements. The Church has already declared a war on gays by calling us members of the KKK, by financing all groups and organizations that oppose gay rights, by making Catholic politicians and Bishops sign anti-gay pledges, and by declaring homosexuality as ' intrinsically disordered.' Almost all Catholic politicians, leaders, and officials have attacked gay people one way or another all due to adherence to Vatican dogma. General Peter Pace who said that gay soldiers are immoral and shouldn't be in the military and Justice Scalia saying that it is okay to make laws against gays in accordance to morality are among many of our civil servants who are Catholic who are happy to break down gay people's morale and to stop our pursuit of liberty.
Our country enjoys a right to religious liberty as well, but that does not mean that one religion will take over an entire branch of government for the benefit of that one religion at the cost of other religions' religious liberty. What the Vatican wants is not liberty or autonomy, what it wants is power and the obstruction of religious liberty. Of course, mentioning this fact of how our Court has been intentionally hijacked by the Vatican will provoke the ire of many Catholic apologists and hot heads like Bill Donohue, even though if the tables were turned and instead we were to have six gay justices on the Court, Bill and his Catholic cohorts will no doubt cry foul.
What he have is not a court but a Catholic Boy's Club comprised of altar boys who are tied to the Priests' will. The threat of excommunication is very real for any Catholic judge that rules in favor of gay marriage. It is a reality we must face. And with that I cannot predict how the Court will rule on Prop 8. In fact I would not be surprised if they would rule against gay marriage all because the Pope and US Catholic Bishops said so. For now I am only confident in saying that it is 50/50 right now. Justice Kennedy and Sotomayor will be the ones that I will keep my eye on. And It will not shock me if both justices rule against us.
Maybe I am wrong. Maybe these two souls will find that joining the majority of the Catholic laity will not hurt them, but will make them icons of justice where such justice has been deprived. If these two justices rule in our favor it will show us that the system is still somewhat promising, that even Supreme Court Justices who are Catholic and under the pendulum of excommunication rule in favor of equal treatment under the law and that gay couples who are similarly situated will have their rights protected by recognizing such self-evident realities instead of sucking up to a foreign church.
